How Good an Account of Promissory Obligation Is the Reliance Model?
이 글의 주된 목적은 비결과주의 관점에서 약속 의무를 정당화하는 의존모델(the reliance model)의 한계를 밝히는 데 있다. 톰슨이 제시한 의존모델에 따르면, 약속인(promiser)이 피약속인(promisee)에게 무엇을 하겠다고 약속함은 전자가 후자에게 그 약속에 의존할 것을 요청하는 행위이며, 피약속인이 이 요청을 수락하는 한 약속인은 수락된 요청을 임의로 무시할 수 없다. 바로 이러한 맥락에서 약속인은 자신이 한 약속을 이행할 의무를 지게 된다. 의존모델은 두 가지 반론, 즉 의존이 부재하더라도 약속 의무가 성립할 수 있다는 반론과, 의존과 신뢰가 공존하는 사례에서도 오직 신뢰만이 정당화의 실질적 역할을 수행한다는 반론에 직면한다. 이 글은 이에 응답하려는 힙(Heape)의 시도가 모두 실패함을 논증한다. 최근 의존모델과 궤를 같이하면서도 개선된 형태로 평가받는 신뢰모델(the trust model)이 등장했다. 본고는 두 모델 사이의 관계를 심층적으로 분석하며, 의존모델이 또 다른 치명적 난관, 즉 이 모델의 핵심인 의존 개념이 신뢰 없이는 작동하기 어렵다는 한계에 직면함을 밝힌다. 그러나 신뢰모델의 타당성을 독립적으로 논증하는 것이 이 글의 주된 목적은 아니다. 따라서 약속 의무의 정당화를 위한 비결과주의적 접근의 새로운 방향성 탐구가 중요한 과제로 남게 된다.
This paper seeks to uncover the limitations of the reliance model, a non-consequentialist framework for justifying promissory obligations. According to the reliance model, when a promisor commits to performing an action for a promisee, they invite the promisee to rely on that commitment. As long as the promisee accepts this invitation, the promisor is bound not to disregard it arbitrarily. This perspective grounds the promisor’s obligation to fulfill their promise. However, the reliance model is vulnerable to two key objections: first, that promissory obligations can arise even without reliance; second, that in cases where both reliance and trust are present, only trust substantially justifies the obligation. This paper argues that Heape’s attempts to counter these objections are inadequate. Recently, the trust model has emerged as a refined alternative, sharing roots with the reliance model but considered an improvement. Through a detailed analysis of the relationship between these models, this paper demonstrates that the reliance model faces a critical challenge: its core concept of reliance struggles to function independently of trust. Nevertheless, this paper does not independently evaluate the validity of the trust model. Thus, the need to explore new avenues for non-consequentialist justifications of promissory obligations remains a pressing question.
