포르노그래피와 여성의 발화 행위 ‒ 랭턴과 혼스비의 ‘침묵 주장’에 대한 고찰 ‒
Pornography and Women’s Speech Acts – A Critical Examination of Langton and Hornsby’s ‘Silencing Argument’ –
본 논문은 포르노그래피가 성적 맥락에서 여성의 거절 발화를 침묵시킴으로써 여성의 표현의 자유를 침해한다는 래 랭턴(Rae Langton)과 제니퍼 혼스비(Jennifer Hornsby)의 ‘침묵 주장’을 옹호하는 것을 목적으로 한다. 비판가들은 침묵 주장이 청자의 ‘수용’을 발화수반행위의 필수 조건으로 설정하는 잘못된 화행이론적 가정에 기반하고 있을 뿐만 아니라, 표현의 자유 개념 자체를 과도하게 확대 해석했다고 지적해 왔다. 본고에서는 이러한 비판에 대응하여 랭턴과 혼스비의 침묵 주장이 어떻게 성공적으로 옹호될 수 있는지를 보이고자 한다. 이를 위한 본고의 핵심 전략은 ‘단순한 수용 실패’와 ‘체계적인 수용 실패’를 구분함으로써 비판가들의 반례들과 여성의 성적 거절 사례의 유비가 성립하지 않음을 규명하고, 표현의 자유 권리의 침해는 오직 체계적인 수용 실패, 즉 ‘체계적인 의사소통적 실패’에 있음을 주장한다. 이 과정에서 본고는 수용 조건이 발화수반행위의 필수적 성공 조건인지에 관한 기존의 화행이론적 논쟁이 표현의 자유 침해 논제와 관련하여 실질적으로 중요한 이슈가 아님을 드러낸다. 필자는 표현의 자유의 진정한 가치가 단순히 허공에 소리를 낼 소극적 자유에 있는 것이 아니라 실질적인 의사소통적 능력에 있다는 점을 강조하며, 체계적인 수용 장벽이야말로 화자의 표현의 자유 권리를 원천적으로 무력화하는 지배 기제임을 밝힌다. 결과적으로 본고는 화행이론과 관련된 기존의 논쟁으로부터 침묵 주장을 구출해 내고, 포르노그래피가 여성의 표현의 자유를 침해한다는 랭턴과 혼스비의 주장의 핵심적인 정치철학적 함축을 옹호할 수 있는 강건한 토대를 제공한다.
This article aims to defend the ‘silencing argument’ proposed by Rae Langton and Jennifer Hornsby, which claims that pornography silences women’s sexual refusal and thereby infringes upon their freedom of speech. Critics have long challenged this argument, claiming that it relies on a flawed speech-act theoretic assumption that requires the hearer’s ‘uptake’ as a necessary condition for a successful illocutionary act, and that it overextends the concept of free speech. In response to these objections, I show how Langton and Hornsby’s silencing argument can be successfully defended. My central strategy is to distinguish between ‘simple uptake failure’ and ‘systematic uptake failure’, thereby demonstrating that the analogy between the critics’ counterexamples and cases of women’s sexual refusal does not hold. On this basis, this paper argues that the violation of free speech lies exclusively in systemic failure of uptake—that is, ‘systemic communicative failure.’ In doing so, this paper reveals that the conventional speech-act theoretic debate over whether uptake is a necessary condition for illocutionary success is irrelevant to the thesis of free speech infringement. Emphasizing that the genuine value of free speech lies not in the mere negative liberty to make noises in the air but in a substantive communicative capability, I argue that systematic barriers to uptake function as a dominant mechanism that fundamentally neutralizes the speaker’s right to free speech.
