AI 시대의 차이나 질서, 파르마콘으로서의 중국 ‒ 디지털 법가-레닌주의와 푸코의 통치성 ‒
The Chinese Order in the AI Era, China as Pharmakon – Digital Legalist-Leninism and Foucault’s Governmentality –
본 연구는 현대 중국의 복합적인 통치 체제를 규명하기 위해 레드·법가·공자·디지털이라는 네 가지 요소가 역사적 상황에 따라 유연하게 결합한 ‘절합(articulation)의 하이브리드 제국’이라는 분석 틀을 제시한다. 특히 그간 유가의 덕치나 마르크스주의의 외피에 가려져 있던 ‘법가차이나’가 체제의 실질적 하드웨어로서 어떻게 작동하고 있는지에 주목한다. 이 글은 중국 사회주의가 소련의 붕괴와 달리 강력한 생존력을 발휘하며 G2로 부상할 수 있었던 근본 동력은 인간의 이기적 욕망을 냉철하게 관리하는 법가적 통치 공학이 현대의 기술 및 경제성장과 성공적으로 결합한 때문이라고 본다. 이러한 법가적 기제는 마오쩌둥 시기 레닌주의 당-국가 체제와 절합되어 권력의 골조를 형성했으며, 시진핑 시대에 이르러 빅데이터와 알고리즘을 통한 ‘디지털 법가-레닌주의’로 정교화되며 체제의 복원력을 극대화했다. 이처럼 고도화된 시스템이 단순히 외적 신체를 구속하는 것을 넘어 인민의 주체 형성과 일상적 실천을 어떻게 규정하는지 파악하기 위해, 본고는 푸코의 통치성(governmentality) 개념을 분석의 도구로 소환한다. 푸코적 관점에서 볼 때, 중국의 디지털 감시는 단순한 물리적 억압을 넘어 인민의 삶 속에 문화적으로 착근되어 ‘생산적 권력’으로 기능하며 자발적 순응과 자기검열을 내면화하기 때문이다. 결론적으로 현대 중국의 통치는 권력의 약화가 아니라 통치성의 보완을 통한 권력 형식의 성공적인 전환이며, 이러한 ‘파르마콘(pharmakon)’적 성격을 지닌 중국식 질서에 대해 한국 사회는 비판적이고 독자적인 분석 언어를 확보해야 한다.
This study presents an analytical framework of the “hybrid empire of articulation,” in which four elements—Red China, Legalist China, Confucian China, and Digital China—are flexibly combined according to historical contexts to identify the complex governance system of contemporary China. In particular, it focuses on how “Legalist China,” long obscured by the veneers of Confucian moral governance or Marxism, functions as the system’s substantive hardware. The fundamental driving force that allowed Chinese socialism to survive the collapse of the Soviet Union and emerge as a G2 power lies in the successful integration of Legalist governance engineering—which dispassionately manages human egoistic desires—with modern technology and economic growth. These Legalist mechanisms articulated with the Leninist party-state system during the Mao Zedong era to form the structural framework of power, and in the Xi Jinping era, they have been further refined into “Digital Legalist-Leninism” through big data and algorithms, maximizing the system’s resilience. To understand how this sophisticated system defines the formation of subjects and the daily practices of the people beyond mere physical restraint, this paper employs Foucault’s governmentality as an analytical tool. From a Foucauldian perspective, China’s digital surveillance functions as a “productive power” culturally embedded in the lives of the people, internalizing voluntary compliance and self-censorship beyond simple physical oppression. In conclusion, contemporary Chinese governance represents a successful transformation of the form of power through the supplementation of governmentality rather than a weakening of authority. Regarding the Chinese-style order, which possesses such a “pharmakon” character, Korean society must secure its own critical and independent analytical language.
