A Critique of Visa Kurki’s New Theory of Legal Personhood

필자는 이미 다른 지면에서 쿠르키의 새로운 법인격론(이른바 ‘다발이론’)을 소개하고 그 의의와 성과, 그리고 한계점에 대해 간략히 논평한 바 있다. 본고는 그러한 작업의 후속편에 해당한다. 본고에서는 그 이론의 의의와 성과를 재조명하는 한편, 그것의 한계점을 다각도로 제시하고 더욱 심도있게 논의하고자 했다. 각 비판 논점마다 나름의 타당한 근거를 제시하고자 했다. 다음 네 가지가 그 비판 논점이다. 첫 번째 쟁점은 다발이론의 타당성에 관한 것으로, 다발이론을 위한 출발점이라 할 외연적 신념사항은 과연 참인가, 그것은 법인격론을 평가하기 위한 잣대로서 적절한가 하는 문제다. 두 번째 쟁점은 첫 번째 쟁점의 연장선상에 있는 것으로, 다발이론을 위한 중심 논제라 할 불일치(discrepancey) 논제가 과연 성립하는가 하는 문제다. 세 번째 쟁점은 다발이론이 (법인격 개념에 대한) 설명적 역할을 하는가, 어쩌면 다발이론은 단지 법인격 개념이 법률주의적으로 어떠한가(how)에 대한 답을 줄 뿐 왜 그러한가(why)에 대한 답을 주지 않는 것 아닌가 하는 쟁점이다. 마지막 쟁점은 다발이론이 과연 (하나의) 이론인가 하는 것이다.
I have previously introduced Visa Kurki’s theory of legal personhood in another article, providing a brief commentary on its significance, achievements, and limitations. This paper serves as a follow-up to that work. In this paper, I aim to reexamine the significance and contributions of the theory while presenting its limitations from various perspectives and discussing them in greater depth. I have attempted to provide valid grounds for each critical point. However, as mentioned at the outset, ‘legal personality’ encompasses a wide array of connotations and usages, making the task of formulating a unified theory of legal personality a highly challenging endeavor.
This paper presents and examines five critical points regarding Kurki’s legal theory. The first issue pertains to the validity of the bundle theory, questioning whether the extensional beliefs that serve as its starting point are indeed true and whether these beliefs are appropriate criteria for evaluating a theory of legal personality. The second issue is an extension of the first, questioning whether the discrepancy thesis―central to the bundle theory―actually holds. The third issue examines whether the bundle theory plays an explanatory role regarding the concept of legal personality or whether it merely addresses the “how” of legal personality from a legalistic perspective without answering the “why.” The final issue questions whether the bundle theory is truly a theory at all.
